1. Introduction
These Terms and Conditions govern the use of this website and the booking of tours, safaris, transfers, travel arrangements, itineraries and related services offered by African Blue Tours.
By using this website, submitting an enquiry, accepting a quotation, making a payment, or confirming a booking with African Blue Tours, you agree to be bound by these Terms and Conditions.
If you do not agree with these Terms and Conditions, please do not use this website or book services with us.
2. Who We Are
African Blue Tours is a boutique private tour operator based in Cape Town, South Africa. We specialise in private tailor-made tours, safaris and travel experiences in South Africa and selected Southern African destinations.

3. Definitions
In these Terms and Conditions:
- “African Blue Tours”, “we”, “us” or “our” means African Blue Tours.
- “Client”, “traveller”, “you” or “your” means the person using this website, submitting an enquiry, accepting a quotation, or booking travel services with us.
- “Services” means tours, safaris, transfers, travel planning, itinerary design, accommodation arrangements, activities, excursions and related travel services arranged by African Blue Tours.
- “Supplier” means any third-party provider, including accommodation establishments, lodges, hotels, guides, transfer operators, vehicle providers, activity providers, airlines, restaurants, venues or other travel service providers.
- “Booking” means a confirmed travel arrangement accepted by African Blue Tours and the Client, usually after payment of a deposit or full payment.
- “Itinerary” means the travel plan, proposal, quotation or programme prepared for the Client.
4. Website Use
This website is provided for general information, travel inspiration and enquiry purposes. While we aim to keep website content accurate and up to date, information may change without notice.
You agree not to use this website for any unlawful, harmful, fraudulent or abusive purpose, including attempting to interfere with the website’s security, copying website content without permission, or submitting false information.
5. Enquiries and Travel Proposals
Submitting an enquiry through this website does not create a confirmed booking. A booking is only confirmed once African Blue Tours has issued a written confirmation and the required deposit or full payment has been received.
All proposed itineraries, routes, accommodation, activities, availability and prices are subject to change until the booking is confirmed.
We reserve the right to amend quotations where supplier prices, availability, exchange rates, fuel costs, taxes, park fees, conservation levies, government charges or other external costs change before confirmation.
6. Accuracy of Information Provided by You
You are responsible for ensuring that all information provided to African Blue Tours is accurate, complete and up to date.
This includes names, contact details, travel dates, passport details, dietary requirements, medical or mobility requirements, ages of children, rooming requirements, flight details and any other information needed to arrange your journey.
African Blue Tours will not be liable for loss, delay, cancellation, additional cost or inconvenience caused by incorrect, incomplete or late information supplied by you.
7. Quotations and Pricing
All prices are quoted in the currency stated in the quotation. If no currency is stated, prices are deemed to be quoted in South African Rand.
Quotations are valid for the period stated in the quotation. If no validity period is stated, the quotation is valid for 7 calendar days, subject to availability and supplier confirmation.
Prices may include or exclude certain items depending on the itinerary. Please review your quotation carefully before confirming.
Unless expressly stated in writing, prices do not include international flights, visas, passports, travel insurance, meals not specified, drinks, gratuities, personal expenses, optional activities, medical expenses, excess baggage, bank charges, or any services not specifically listed as included.
8. Booking Confirmation
A booking is confirmed only once:
- you have accepted the quotation or itinerary in writing;
- African Blue Tours has confirmed availability;
- the required deposit or full payment has been received; and
- African Blue Tours has issued written booking confirmation.
Until confirmation has been issued, all services remain subject to availability.
9. Deposits and Payments
A non-refundable or partially refundable deposit may be required to secure your booking. The deposit amount and payment deadlines will be stated in your quotation or invoice.
The balance of payment must be paid by the due date stated on your invoice. If payment is not received on time, African Blue Tours reserves the right to cancel the booking and apply applicable cancellation charges.
Some suppliers require full prepayment or have strict payment deadlines. Where this applies, you will be advised as far as reasonably possible.
10. Bank Charges and Payment Costs
All bank charges, foreign exchange charges, international transfer fees, card charges or intermediary bank costs are for the Client’s account, unless otherwise agreed in writing.
African Blue Tours must receive the full invoice amount, net of any payment charges.
11. Cancellations by the Client
All cancellation requests must be submitted in writing to African Blue Tours.
Cancellation charges depend on the services booked, the date of cancellation, supplier terms, non-refundable deposits, prepayments already made, and any reasonable costs incurred by African Blue Tours.
Unless otherwise stated in your quotation, the following general cancellation guideline may apply:
- More than 90 days before travel: deposit and any non-refundable supplier costs may be forfeited.
- 61 to 90 days before travel: up to 50% of the total booking value may be charged.
- 31 to 60 days before travel: up to 75% of the total booking value may be charged.
- 30 days or less before travel: up to 100% of the total booking value may be charged.
- No-show or early departure: 100% cancellation charge may apply.
These cancellation terms are a general guide only. Specific supplier cancellation policies may be stricter and will take precedence where applicable.
Where the South African Consumer Protection Act applies, any cancellation charge will be assessed with reference to applicable legal requirements, including the timing of cancellation, the nature of the services, the ability to re-sell the service, and costs already incurred. 12. Cancellations by African Blue Tours
African Blue Tours reserves the right to cancel a booking where necessary due to circumstances beyond our reasonable control, non-payment, supplier failure, safety concerns, force majeure, or any other reason that makes the delivery of services impossible, unsafe or impractical.
If we cancel a booking for reasons not caused by you, we will use reasonable efforts to offer an alternative arrangement or refund amounts recoverable from suppliers, less any unrecoverable costs already incurred.
13. Changes by the Client
Any request to change a confirmed booking must be submitted in writing.
Changes are subject to availability, supplier approval and additional costs. African Blue Tours may charge an amendment or administration fee where changes require additional work or result in supplier charges.
Changes close to the date of travel may not be possible or may result in substantial additional charges.
14. Changes to Itineraries
Travel arrangements may be affected by weather, road conditions, park regulations, flight changes, supplier availability, safety issues, operational requirements or circumstances beyond our control.
African Blue Tours reserves the right to make reasonable changes to itineraries where necessary. We will aim to provide services of a similar nature and standard where possible.
No refund will necessarily be due where changes are caused by circumstances beyond our reasonable control or where substitute arrangements of similar value are provided.
15. Third-Party Suppliers
African Blue Tours arranges certain services through independent third-party suppliers. These may include accommodation providers, lodges, restaurants, guides, transfer companies, activity operators, airlines and other travel providers.
Although we take reasonable care in selecting suppliers, African Blue Tours does not own, control or manage all supplier operations and is not responsible for acts, omissions, negligence, delays, cancellations, changes, losses, injuries, damages or failures caused by third-party suppliers.
Supplier terms and conditions may apply in addition to these Terms and Conditions.
16. Travel Insurance
Comprehensive travel insurance is strongly recommended for all travellers and may be required for certain itineraries.
Your insurance should cover cancellation, curtailment, medical expenses, emergency evacuation, personal injury, baggage loss, theft, travel delays, missed connections, supplier insolvency, adventure activities and any other risks relevant to your journey.
It is your responsibility to ensure that your travel insurance is adequate for your needs and that it covers all destinations, activities and travellers in your group.
African Blue Tours is not responsible for any loss suffered because you failed to obtain suitable travel insurance.
17. Passports, Visas and Travel Documents
You are responsible for ensuring that you and all travellers in your party have valid passports, visas, permits, health documents, vaccination records and any other documents required for travel.
Passport, visa and entry requirements may change without notice. You should confirm requirements with the relevant embassy, consulate, airline or government authority before travelling.
African Blue Tours will not be liable for loss, cancellation, refusal of entry, deportation, delay or additional costs caused by invalid, incomplete or missing travel documents.
18. Health, Medical Conditions and Fitness to Travel
You are responsible for ensuring that you are medically fit to travel and participate in the activities included in your itinerary.
You must inform African Blue Tours in writing of any medical condition, disability, allergy, dietary requirement, mobility limitation, pregnancy, special need or other factor that may affect your travel arrangements.
Some destinations and activities may involve walking, uneven terrain, wildlife areas, long drives, heat, altitude, remote locations or limited medical facilities. It is your responsibility to assess suitability before confirming your booking.
19. Safari, Wildlife and Adventure Activities
Safaris, wildlife experiences, marine activities, hiking, adventure activities and travel in natural areas involve inherent risks.
Wild animals are unpredictable, and sightings cannot be guaranteed. African Blue Tours and its suppliers will take reasonable safety precautions, but you participate in such activities at your own risk.
You must follow all safety instructions given by guides, rangers, drivers, suppliers and authorised personnel.
20. Conduct of Travellers
You are expected to behave respectfully and responsibly toward guides, suppliers, staff, local communities, wildlife, other travellers and property.
African Blue Tours or its suppliers may refuse service, remove a traveller from an activity, or terminate travel arrangements where a traveller behaves unlawfully, dangerously, abusively, disruptively, intoxicatedly or in a way that endangers others.
No refund will be due where services are refused or terminated because of unacceptable conduct.
21. Special Requests
Special requests, including room preferences, dietary requirements, accessibility requirements, guide preferences, celebration arrangements or specific vehicle requests, should be provided in writing as early as possible.
We will make reasonable efforts to assist, but special requests cannot be guaranteed unless expressly confirmed in writing.
22. Flights and Transport Delays
Unless expressly stated, international and domestic flights are not included in our services.
African Blue Tours is not responsible for airline schedule changes, cancellations, missed connections, baggage delays, airport delays, strikes, weather disruption or other transport-related issues outside our control.
Additional costs caused by flight or transport disruption are for the Client’s account, unless recoverable from a supplier or insurer.
23. Force Majeure
African Blue Tours will not be liable for any failure, delay, loss, damage or additional cost caused by circumstances beyond our reasonable control.
These circumstances may include, but are not limited to, natural disasters, extreme weather, fire, flood, drought, disease outbreak, pandemic, epidemic, war, terrorism, civil unrest, strikes, government action, border closures, travel restrictions, supplier failure, power failures, road closures, accidents, wildlife incidents, airline disruption or any other event outside our reasonable control.
24. Limitation of Liability
To the fullest extent permitted by law, African Blue Tours will not be liable for indirect, consequential, special or punitive losses, including loss of enjoyment, loss of profit, loss of opportunity, emotional distress, inconvenience, or loss arising from circumstances beyond our reasonable control.
Where liability cannot lawfully be excluded, African Blue Tours’ liability will be limited to the amount paid by you to African Blue Tours for the specific service giving rise to the claim, unless applicable law requires otherwise.
Nothing in these Terms and Conditions excludes liability where such exclusion is not permitted by law.
25. Indemnity
You agree to indemnify African Blue Tours against any claim, loss, damage, cost or expense arising from:
- incorrect or incomplete information provided by you;
- your breach of these Terms and Conditions;
- your unlawful, negligent or reckless conduct;
- your failure to comply with supplier rules or safety instructions;
- your failure to obtain passports, visas, insurance or health documents;
- claims made by members of your travelling party where you booked on their behalf.
26. Complaints
If you experience a problem during your journey, you must notify African Blue Tours or the relevant supplier as soon as reasonably possible so that we have an opportunity to assist.
If the issue is not resolved during travel, any formal complaint must be submitted in writing within 14 calendar days after the end of your journey.
Failure to report issues promptly may limit our ability to investigate or resolve the matter.
27. Website Content and Intellectual Property
All website content, including text, images, graphics, design, logos, layout, itineraries and other materials, belongs to African Blue Tours or its licensors, unless otherwise stated.
You may view and print website content for personal, non-commercial travel planning purposes only.
You may not copy, reproduce, distribute, publish, modify, sell or use website content for commercial purposes without our prior written consent.
28. Links to Third-Party Websites
This website may contain links to third-party websites, including accommodation providers, travel resources, review platforms, social media platforms, maps or other services.
These links are provided for convenience only. African Blue Tours is not responsible for the content, privacy practices, security or terms of third-party websites.
29. Privacy and Personal Information

By submitting an enquiry, booking travel services or communicating with us, you consent to the collection and use of personal information necessary to process your enquiry, prepare itineraries, make reservations, communicate with suppliers, manage bookings and provide travel services.

30. Marketing Communications
We may send you travel updates, newsletters or marketing communications where you have consented or where permitted by law.
You may unsubscribe from marketing communications at any time by contacting us or using the unsubscribe option provided in our emails.
31. Consumer Protection
Where applicable, these Terms and Conditions are subject to the Consumer Protection Act 68 of 2008 and other applicable South African consumer laws.
Nothing in these Terms and Conditions is intended to unlawfully limit, exclude or avoid any mandatory consumer rights that apply to you.
32. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Unless otherwise required by applicable law, any dispute arising from these Terms and Conditions, website use or services provided by African Blue Tours will be subject to the jurisdiction of the courts of South Africa.
33. Changes to These Terms and Conditions
African Blue Tours may update these Terms and Conditions from time to time.
The latest version will be published on this website with an updated effective date. Continued use of the website or services after changes are published will constitute acceptance of the updated Terms and Conditions.
